The mother is currently deciding whether to have a Caesarean section. In some cases, the mother opts for a natural delivery, while a cesarean section is actually necessary for the health of the baby.
In the Medical Contact, two judges and gynaecologists argue that in some cases the doctor should be able to decide whether a caesarean section is necessary. The doctor should be able to go to court.
It is not the intention that the mother has nothing more to say, but according to the group of judges and gynaecologists it should not always be a closed case if the mother says no. The gynecologist and judge should be able to make the decision in such a case.
There are not many situations in which this will play out. In the Erasmus MC in Rotterdam there is such a situation about 2 to 3 times a year. With the current regulations, the doctors are not allowed to do anything, while in some cases it leads to the death of the child.
